The Mainland of China : Impending Expiry of Anti-dumping Measures against Imports of Chloroprene Rubber from Japan, the United States and the European Union and Imports of Trichloroethylene from Russia and Japan
The Ministry of Commerce (MOC) issued Notice No. 104/2009 on 2 December 2009, announcing the impending expiry of anti-dumping measures against imports of chloroprene rubber from Japan, the United States and the European Union and imports of trichloroethylene from Russia and Japan. The relevant tariff codes of chloroprene rubber are 4002 4910 and 4002 4990 and the relevant tariff code of trichloroethylene is 2903 2200.

According to the "Regulation on Anti-dumping", the duration of levying anti-dumping duty can be suitably extended if a review confirms that the removal of duty would likely cause the continuance or recurrence of injury to the domestic industries. As such, from the date of announcement (i.e. 2 December 2009) and no later than 60 days before the expiry of the anti-dumping measures, domestic enterprises or their representatives may submit applications to the MOC to request a review. The applications should include evidence that injury would be likely to continue or recur if the duty is removed.

If no application for a review is submitted in accordance with the notice nor the MOC considers warrant initiating a review before the expiry date of the anti-dumping measures, the anti-dumping measures against imports of chloroprene rubber from Japan, the United States and the European Union and imports of trichloroethylene from Russia and Japan will be terminated on 10 May 2010 and 22 July 2010 respectively.
